Terms of Service

By accessing or using KaushGar Setu ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Platform. These Terms constitute a legally binding agreement between you and KaushGar Setu.

These Terms apply to all users, including Trainees (Leads/Candidates), KaushGar Mitras (Referral Partners), Skill Centre operators, Trainers, Business Owners, Employers, and administrative staff.

• Age Requirement: Users must be at least 14 years old. Users aged 14–18 require parental/guardian consent. • Indian Citizenship: The Platform is primarily designed for Indian citizens and residents. • Accurate Information: You must provide truthful, accurate, and complete information during registration. Misrepresentation of identity, qualifications, or credentials may result in immediate account suspension. • One Account Per Person: Each individual may maintain only one active account. Duplicate accounts will be merged or deactivated. • Account Security: You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately at info@kaushgar.com if you suspect unauthorized access.

Your use of the Platform is also governed by our Privacy Policy, which details how we collect, use, and protect your personal data. Key commitments:

• We collect only necessary information for platform operations. • Your data will not be sold to third parties for marketing. • Sensitive data (Aadhaar, bank details) is encrypted and access-restricted. • You may request data deletion at any time via our Data Deletion page. • We comply with applicable Indian data protection regulations.

For KaushGar Mitras:

• Referral incentives are earned upon verified milestone completion (registration → enrollment → training completion → placement → retention). • Incentive amounts are defined by the active incentive structure and may be revised with notice. • Earned incentives are credited to your KaushGar Wallet after verification by the operations team. • Wallet withdrawals are subject to minimum balance thresholds and processing timelines (typically 7–14 business days). • Fraudulent referrals (fake candidates, duplicate entries, misrepresented data) will result in incentive forfeiture and potential account suspension. • Tax obligations on incentive earnings are the sole responsibility of the Mitra.

• Free Training: Skill training programs listed on KaushGar Setu are provided free of charge to candidates under government skilling schemes. • No Guaranteed Employment: While we actively facilitate job matching and placement, we do not guarantee employment. Placement depends on candidate skills, employer requirements, market conditions, and candidate cooperation. • Certification: Training completion certificates are issued by authorized bodies (e.g., NSDC, Sector Skill Councils) and are subject to assessment performance. • Post-Placement Support: We provide retention tracking and support for up to 12 months post-placement, but are not responsible for employer-side employment terms, salary disputes, or workplace conditions.

• Provide accurate and honest job descriptions including wages, location, working hours, and benefits. • Comply with all applicable labor laws including Minimum Wages Act, Factories Act, and state-specific regulations. • Not charge any fees to candidates for job placement or interviews. • Provide safe working conditions as mandated by law. • Report placement outcomes (joining confirmations, retention status) to the Platform as requested. • KaushGar Setu reserves the right to delist employers or remove job postings that violate these guidelines or receive verified complaints.

• All content on KaushGar Setu - including text, graphics, logos, icons, images, software, and design - is the intellectual property of KaushGar Setu or its licensors. • You may not copy, reproduce, distribute, modify, or create derivative works from any Platform content without prior written permission. • User-generated content (profile information, uploaded documents) remains your property, but you grant us a non-exclusive license to use it for Platform operations.

You agree NOT to:

• Create fake accounts or submit false information • Refer non-existent or unwilling candidates for incentive fraud • Scrape, crawl, or extract data from the Platform without authorization • Attempt to access other users' accounts or data • Upload malicious code, viruses, or harmful content • Use the Platform for any unlawful purpose • Harass, threaten, or discriminate against other users • Circumvent security measures or access controls

Violation of these rules may result in immediate account termination and legal action.

• KaushGar Setu is provided on an "as is" and "as available" basis. • We do not warrant uninterrupted, error-free, or secure access to the Platform. • We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform. • Our total liability in any matter related to the Platform shall not exceed ₹10,000 or the amount paid by you in the preceding 12 months, whichever is lower. • We are not responsible for actions, omissions, or conduct of any employer, Skill Centre, trainer, or third-party service provider.

• By You: You may deactivate your account at any time by contacting support or submitting a deletion request at /delete-account. • By Us: We reserve the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or misuses the Platform, with or without prior notice. • Effect of Termination: Upon termination, your access to the Platform ceases. Earned but unpaid Mitra incentives (for verified milestones) will be processed within 30 days. Data deletion follows our Privacy Policy. • Survival: Sections on Limitation of Liability, Intellectual Property, and Dispute Resolution survive termination.

• These Terms are governed by the laws of India. • Any disputes arising from the use of this Platform shall be subject to the exclusive jurisdiction of courts in Jaipur, Rajasthan. • Before initiating formal proceedings, parties agree to attempt resolution through good-faith negotiation for a period of 30 days. • For unresolved disputes, arbitration under the Arbitration and Conciliation Act, 1996 shall apply, with the seat of arbitration in Jaipur.
